Plain-language summary. Use FramSHOT to make your own creative projects. Don't use it to break the law, hurt people, or impersonate anyone. You own what you generate. We're not liable for content you choose to create with the tool. You agree to defend us if a third party sues us because of something you made. We may change features over time. If there's a problem, email us first — we're one person and we'll try to work it out. The detailed version is below.
These Terms of Service ("Terms") form a legally binding agreement between you ("you," "your," or "User") and Jean F., operating as FramSHOT ("FramSHOT," "we," "us," or "our"), based in Madagascar. They govern your access to and use of:
The FramSHOT website (currently at www.framshot.com and studio.framshot.com)
The FramSHOT Studio web application
The FramSHOT Desktop application (when released)
The FramSHOT API (when released)
Any associated services (collectively, the "Service")
By accessing, visiting, registering for, or using the Service in any way, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
2. Eligibility & your account
You must be at least 16 years old (or the minimum age of digital consent in your country, whichever is higher) to use FramSHOT. If you are using the Service on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.
When real signup launches, you will be responsible for:
Providing accurate and complete information during registration
Keeping your login credentials secure and confidential
Not sharing your account with others
Notifying us immediately at contact@framshot.com of any unauthorized access or security breach of your account
All activity that occurs under your account, whether authorized by you or not
We reserve the right to suspend or terminate accounts that provide false information, share credentials, or are otherwise operated in violation of these Terms.
3. Acceptable use & prohibited conduct
You may use FramSHOT to create films, storyboards, animations, short series, music videos, marketing content, educational material, and any other creative project that you have the lawful right to make and distribute.
You may not use FramSHOT to:
Generate child sexual abuse material (CSAM) or any sexual content involving minors, in any form, under any circumstance. This is a zero-tolerance policy. Violation results in immediate termination and reporting to authorities.
Generate non-consensual intimate imagery of real people (sometimes called "revenge porn" or sexual deepfakes) — whether the person is a public figure, a private individual, or anyone else.
Generate content that impersonates real identifiable individuals in ways that could defame them, misrepresent their views, damage their reputation, or create fraudulent impersonation of public figures (living or recently deceased).
Generate content designed to incite violence, hatred, or discrimination against any individual or group based on race, ethnicity, religion, gender, gender identity, sexual orientation, nationality, disability, or other protected characteristic.
Generate false or deceptive content about matters of public interest — political disinformation, fabricated news events, fake quotes from public officials, fraudulent emergency alerts, etc.
Generate content that infringes intellectual property rights of others — copyrighted characters, trademarks, brands, or other protected elements without permission from the rights holder.
Generate content that violates export controls or contains classified, controlled, or embargoed information.
Bypass or attempt to bypass safety filters in FramSHOT or in the underlying AI providers.
Resell, sublicense, or provide wrapper services around FramSHOT to third parties without our written permission.
Scrape, extract, or reverse-engineer the Studio interface, API, or underlying code in violation of applicable law.
Use automated means (bots, scripts, crawlers) to access the Service at a rate that would degrade performance for other users, or to automate account creation.
Use the Service to train competing AI models on outputs generated through FramSHOT.
Consequences of violation. We reserve the right to suspend or terminate your account immediately, with or without notice, for any violation of this section. We may also report illegal content or conduct to the relevant authorities, and cooperate with law enforcement investigations. If your violation exposes us to legal liability or third-party claims, you agree to the indemnification provisions in Section 14 below.
4. License to use FramSHOT
Subject to your compliance with these Terms and your active subscription (where applicable), FramSHOT grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal or business creative projects.
This license does not grant you:
Any ownership interest in FramSHOT's software, user interface, code, trademarks, or documentation
The right to resell, redistribute, or sublicense the Service
The right to remove or alter any proprietary notices
The right to use the FramSHOT name, logo, or trademarks for your own marketing without our written permission
We reserve all rights not expressly granted in these Terms.
5. Your content & your outputs
Your ownership
Anything you generate inside FramSHOT — characters, scenes, wardrobe items, project bibles, exported videos, story notes — remains your property, subject to the license tier you're on:
Free trial (when launched): Personal, non-commercial use only. You can experiment, test, share with friends, post to personal social media — but you cannot use the output in paid commercial work.
Paid plans (Hobbyist, Pro, Studio, BYOK Creator, BYOK Team): Full commercial license. Use the output in films, advertising, books, merchandise, client deliverables, or any other lawful purpose.
FramSHOT does not claim any ownership over your generated content. We do not watermark. We do not take royalty percentages. We do not require attribution.
Our limited license to your content (for operating the service)
To provide the Service, we need a very narrow license from you to handle your content. By using FramSHOT, you grant us a worldwide, royalty-free, non-exclusive license to store, display, process, and transmit your content solely for the purpose of delivering the Service to you. This license:
Ends when you delete the content or terminate your account (plus a short deletion window for backups)
Does not authorize us to use your content to train AI models
Does not authorize us to publish, sell, sublicense, or commercially exploit your content
Does not authorize us to display your content publicly without your consent
AI copyright limitation. The legal status of AI-generated content varies by jurisdiction. As of early 2026, the U.S. Copyright Office requires meaningful human authorship for copyright registration of AI-generated works (see Thaler v. Perlmutter, 2025). The EU, UK, and other jurisdictions are evolving their position. The commercial license we grant you under these Terms is valid as a license from us — meaning we won't sue you for using the outputs. But this license cannot and does not guarantee that your AI-generated output will qualify for copyright protection, trademark registration, or other statutory intellectual property rights in any specific jurisdiction. If you need formal IP protection for commercial output, consult local IP counsel about your specific use case.
6. Input content warranty
When you upload, reference, or describe input content in FramSHOT — for example, uploading a reference photo, describing a real person, or typing a prompt that references existing copyrighted characters or trademarked brands — you warrant and represent that:
You have all necessary rights, permissions, licenses, and consents to use that input content in the way you are using it;
Your use of the input content does not infringe any third party's copyright, trademark, right of publicity, right of privacy, or other legal right;
The input content does not contain personal data of any individual who has not consented to that use;
Your use of the input content complies with all applicable laws.
If a third party claims that your input content infringes their rights, the responsibility is yours, not ours. The indemnification provision in Section 14 covers this.
7. AI-generated content & EU AI Act compliance
FramSHOT is a generative AI system that produces synthetic images, video, and text. Under the EU Artificial Intelligence Act (Regulation (EU) 2024/1689), specifically Article 50, certain obligations apply to outputs of generative AI systems. Here is how those obligations work between FramSHOT and you:
What FramSHOT does (provider obligations)
Our underlying AI provider subprocessors implement machine-readable marking on the outputs they generate (for example, fal.ai's Nano Banana and Google's image models embed provenance metadata such as C2PA or SynthID where available). When you generate content through FramSHOT, you should assume outputs can be detected as AI-generated by content-authentication tools.
What you must do (deployer obligations under Article 50(4))
Your legal obligation as deployer. If you use FramSHOT-generated content to produce either of the following and then publish or distribute it, you are legally required under EU AI Act Article 50(4) to disclose to your audience that the content is AI-generated or manipulated, at the moment they encounter it (not buried in fine print):
A "deep fake" — any image, audio, or video that appreciably resembles an existing real person, object, place, or event and that would falsely appear to an ordinary person to be authentic.
Text published on matters of public interest to inform the public (news articles, political commentary, public health messaging, etc.).
This obligation falls on you as the deployer of the AI system, not on FramSHOT as the tool provider. FramSHOT is not responsible for enforcing your disclosure — that's your job. We strongly recommend that if you're in any doubt, add a visible "AI-generated" label to content you publish.
Limited exceptions apply for obvious creative works (films labeled as fiction, clear satire, parody) and for law enforcement use — but these exceptions are narrow and jurisdiction-specific. If you are publishing anything that could be mistaken for real-world reporting, disclose the AI origin prominently.
Non-EU users
If you are outside the European Union, the EU AI Act may still apply to you if your content is directed at EU audiences. Similar AI-transparency laws are in development in the US (state level), UK, Canada, and Australia. You are responsible for complying with the AI content disclosure rules applicable to your audience's location.
8. Third-party AI providers
FramSHOT generates content using third-party AI providers: fal.ai (image generation), Google AI / Gemini (text and vision), and Atlas Cloud (video, via Seedance 2.0). Full details are in our Privacy Policy Section 6.
When you use the Hosted plan, FramSHOT routes generation requests through our own provider accounts. When you use the BYOK (bring your own keys) plan, your requests go directly from your machine to the providers using your own API credentials.
These providers have their own Terms of Service and Acceptable Use Policies that you must comply with when using FramSHOT, including:
If a provider refuses to generate content, flags your request, or suspends service for any reason, FramSHOT cannot override that decision. We cannot guarantee uninterrupted access to any specific AI model — providers may deprecate, change, or restrict features independently.
9. Payment, billing & refunds
Subscription billing
When paid plans launch, subscription fees will be charged monthly in advance and automatically renewed until you cancel. You can cancel any time from your account dashboard — cancellation takes effect at the end of your current billing cycle. You keep access until then.
Credit top-ups
Top-up credit packs are one-time charges. Credits purchased via top-up roll over for 3 months from the date of purchase.
Pricing & taxes
All prices are listed in United States Dollars (USD). Your local taxes (VAT, GST, sales tax) may be added at checkout based on your billing address. You are responsible for any applicable withholding tax in your jurisdiction.
Refund policy
First-time subscription: We offer a 14-day money-back guarantee on your first paid subscription charge. Email contact@framshot.com within 14 days of your first payment and we'll refund 100%, no questions asked.
Top-up credit packs: Non-refundable once any portion of the credits has been used. If you bought a top-up and used zero credits from it, email us within 14 days and we'll refund.
Subsequent renewal charges: Non-refundable, but you can cancel any time to stop future charges.
Team/Studio plans: Same 14-day rule applies to the first charge.
EU consumers retain any additional rights under applicable consumer protection law, including the EU Consumer Rights Directive right of withdrawal where it applies. Contact us to exercise those rights.
10. Output accuracy disclaimer
AI outputs are not always accurate. FramSHOT uses generative AI models that can produce inaccurate, misleading, unexpected, or factually wrong content. Characters may look slightly different across generations. Text outputs may hallucinate facts or misstate real-world events. Style may drift unexpectedly. Videos may contain visual artifacts. This is inherent to current AI technology and is not a defect in FramSHOT.
You acknowledge that:
AI outputs are suggestions and creative starting points, not verified facts
You should review and edit every output before using it in any context where accuracy matters
You should not rely on FramSHOT outputs for medical, legal, financial, safety-critical, or life-altering decisions
FramSHOT is not responsible for losses or harm resulting from reliance on AI-generated content without human review
11. Service availability & beta disclosure
FramSHOT is currently in early access status. During this period:
Features may be added, removed, or modified without notice
The Service may experience downtime, instability, or data loss risk higher than a mature production service
User onboarding is manual and occurs within 24 hours of waitlist submission on best-effort basis
Pricing and plan structure may change — we'll give 30 days notice to active subscribers if it does
We aim for high uptime but we do not guarantee any specific service level. FramSHOT depends on third-party AI providers, hosting infrastructure, and active development — outages, slowdowns, and feature changes can happen. When we plan maintenance, we'll communicate in advance through email and the website.
If you experience a major outage that prevents you from working for more than 24 consecutive hours due to our fault (not a third-party provider outage), email us and we'll credit your account a pro-rata amount for the downtime.
12. Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
WARRANTIES OF MERCHANTABILITY
WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
WARRANTIES OF NON-INFRINGEMENT
WARRANTIES OF ACCURACY, RELIABILITY, OR AVAILABILITY
WARRANTIES THAT AI OUTPUTS WILL MEET YOUR EXPECTATIONS OR BE FREE FROM ERRORS
WARRANTIES THAT THE SERVICE WILL BE SECURE, UNINTERRUPTED, OR TIMELY
WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE
Some jurisdictions (including some EU member states) do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in full. In that case, our warranties are limited to the minimum extent permitted by the applicable law in your jurisdiction.
13. Limitation of liability
This is the most important clause in these Terms. Read it carefully.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
IN NO EVENT WILL FRAMSHOT, JEAN F., OR ANY OF OUR AFFILIATES, CONTRACTORS, OR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST DATA, LOST GOODWILL, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, WHETHER IN CONTRACT, TORT, WARRANTY, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED US DOLLARS ($100 USD), OR (B) THE TOTAL AMOUNT YOU ACTUALLY PAID TO FRAMSHOT IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, AND REGARDLESS OF WHETHER THE REMEDY IS DETERMINED TO HAVE FAILED ITS ESSENTIAL PURPOSE.
SOME JURISDICTIONS DO NOT ALLOW LIMITATION OR EXCLUSION OF CERTAIN DAMAGES. IN THOSE JURISDICTIONS, THE ABOVE LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, or fraud.
For EU consumers: nothing in this section affects your mandatory statutory consumer protections. If a consumer-protection law in your EU member state provides stronger protections than what's described above, that law prevails for you.
14. Indemnification
You agree to defend, indemnify, and hold harmless FramSHOT, Jean F., and our contractors, affiliates, licensors, and service providers from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
Your use or misuse of the Service
Your violation of these Terms, including the Acceptable Use provisions in Section 3
Your violation of any third party's intellectual property, privacy, publicity, or other rights — including through input content you supply under Section 6
Your violation of any applicable law, including the EU AI Act disclosure obligations in Section 7
Any content you generate, publish, distribute, or use that causes harm to a third party
Any false or misleading information you provided in creating your account
We will notify you of any such claim, and we reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you at our own expense.
If you believe that content generated, hosted, or accessible through FramSHOT infringes your copyright, please send a notice to contact@framshot.com with the subject line "Copyright infringement notice" and include:
Your physical or electronic signature
Identification of the copyrighted work you claim has been infringed
Identification of the specific content on FramSHOT that you believe infringes, with enough detail for us to locate it (URLs or project IDs)
Your contact information (name, address, phone, email)
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
We will review valid notices and remove infringing content within a reasonable time. Repeat infringers will have their accounts terminated. If you believe content was removed in error, you may submit a counter-notice.
This process complies with the safe harbor provisions of the U.S. Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512) and equivalent notice-and-takedown frameworks in the EU and other jurisdictions.
16. Termination
Termination by you
You can terminate your account at any time by canceling your subscription from the dashboard and emailing contact@framshot.com to request account deletion. Upon termination, you have 30 days to export your projects from the Studio before your data is deleted permanently.
Termination by us
We may suspend or terminate your account, with or without notice, if:
You violate these Terms (especially the Acceptable Use section)
You fail to pay subscription or top-up charges that are due
We receive a valid legal order requiring termination
We reasonably believe your account has been compromised
We discontinue the Service entirely (we'll give at least 60 days' notice for this)
Effect of termination
On termination, your license to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (Sections 5, 10, 12, 13, 14, 15, 19, 20, and 21) will survive.
17. Force majeure
Neither party will be liable for any delay or failure to perform under these Terms to the extent caused by events beyond reasonable control, including but not limited to: acts of nature, pandemics, war, civil unrest, terrorism, government action, internet infrastructure failures, cloud provider outages, AI provider suspensions, cyberattacks, or labor disputes.
If a force majeure event prevents us from delivering the Service for more than 30 consecutive days, either party may terminate the affected subscription without further liability, and we will refund any pre-paid unused fees on a pro-rata basis.
18. Sanctions & export control
You represent and warrant that:
You are not located in, under the control of, or a national or resident of any country subject to comprehensive embargoes under applicable international sanctions regimes (as enforced by the UN, US OFAC, EU, UK OFSI, or other competent authorities)
You are not on any list of prohibited or restricted parties published by such authorities
You will not use the Service to develop, produce, or deliver weapons of mass destruction, nuclear material, chemical or biological weapons, or missile technology
We reserve the right to refuse service to anyone whose use would expose us to sanctions liability.
19. Governing law & dispute resolution
These Terms are governed by the laws of Madagascar for general contract interpretation and enforcement, without regard to conflict of laws principles.
For EU consumers: you benefit from any mandatory consumer protection laws of your country of residence. Nothing in this section deprives you of those protections. EU consumers may also use the European Commission's Online Dispute Resolution platform.
For US consumers: disputes may be resolved through the consumer protection framework of your state of residence.
Informal dispute resolution first
Before filing any formal legal action, you agree to first contact us at contact@framshot.com with a clear description of the dispute. We will make a good-faith effort to resolve it within 30 days. Most issues can be fixed with an email.
Formal dispute resolution
Any formal dispute arising from these Terms will be subject to the competent courts of Antananarivo, Madagascar, unless mandatory law of your jurisdiction requires a different venue. EU consumers retain the right to bring proceedings in the courts of their country of residence.
20. Changes to these terms
We may update these Terms from time to time. When we make material changes (changes that reduce your rights, increase your obligations, or significantly change how the Service works), we will:
Update the "Last updated" date at the top of this page
Notify all active subscribers and waitlist members by email at least 30 days before the changes take effect
Display a notice on the FramSHOT homepage for at least 30 days
For non-material changes (typo fixes, wording clarifications, added subprocessor names, new provider references), we will update the page but may not send a notification.
If you continue to use the Service after the effective date of a material change, you accept the updated Terms. If you do not accept them, you may terminate your account and cancel your subscription before the effective date, and we will refund any unused portion of your current billing cycle.
21. General provisions
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and FramSHOT concerning the Service and supersede any prior or contemporaneous agreements.
Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving the original intent.
No waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms to a successor entity in the event of a merger, acquisition, or sale of assets, with notice to you.
No agency relationship. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and FramSHOT.
Language. These Terms are written in English. If we provide translations for convenience, the English version controls in case of any discrepancy.
Notices. We will send legal notices to you at the email address associated with your account. You should send legal notices to us at contact@framshot.com.
